Terms and conditions of use

By confirming your reservation, you agree to these rules and to the Terms of Use available on our website and other platforms.

“Moments Stays” is the company responsible for the website https://momentsstays.com

and its subdomains.

“You” refers to the person who holds an account on the Moments Stays website and/or the guest making a property reservation with Moments Stays.

Below are the main points that govern your stay:

OBJECT

The purpose of this AGREEMENT is the short-term rental of the property managed by MOMENTS STAYS for you.

All properties listed on the website are residential, without hotel characteristics, and comply with Brazilian seasonal rental laws.

You acknowledge awareness of local rules, neighborhood regulations, and municipal, state, and federal laws, agreeing to abide by them — especially those related to “disturbance of public order”.

You also declare awareness of the condominium’s internal regulations where the property is located and agree to comply with them.

You must return the property and all of its belongings in the same condition in which they were delivered.

Any infraction, damage to the property, or its contents will be your responsibility, and repair costs will be charged in advance according to a verified estimate, in addition to any applicable fines established herein.

IDENTIFICATION AND ACCESS

Information at the time of booking:

The number of guests (including people and pets) must be correctly filled in at the time of reservation for proper evaluation, planning, and pricing of your stay.

The reservation is your responsibility and cannot be made on behalf of third parties.

Mandatory documentation:

In addition to you, all accompanying guests — including children — must present a valid identification document to enter the property or condominium.

Without this documentation, check-in will not be authorized.

Visitors:

Entry of visitors must be pre-authorized by the host.

Unauthorized persons will incur a fine of R$ 300.00 per additional person for each hour of stay in the property.

You authorize the storage of the following information:

Full name

Date of birth

Identity card or passport number

CPF (for Brazilian citizens)

Full address

Telephone number and email

Check-in and check-out times

Name and ID of other guests

WEB CHECK-IN

To ensure proper planning of your stay, it is mandatory to complete the pre-check-in form (Web Check-in) within the following time frames, counted from the reservation confirmation:

Reservations made more than 30 days in advance: must be completed within 48 hours after confirmation.

Reservations made less than 30 days in advance: must be completed within 24 hours after confirmation.

Reservations made less than 7 days in advance: must be completed within 1 hour after confirmation.

Extra Services:

No extra or additional services are offered unless expressly pre-approved in writing by the administration prior to check-in.

SAFETY AND RESPONSIBILITY

Accident Prevention:

Make sure to turn off all electronic devices and close doors and windows when leaving the property.

Responsibility for Valuables:

You are responsible for your personal belongings. Do not leave personal items in common areas or keep the property unlocked.

It is recommended that you store valuable items in a secure location.

Damage to the Property:

Any damage caused to the property, decorative items, or equipment will be charged directly to the responsible guest.

Child and Elder Safety:

Children and elderly guests must be supervised by an adult at all times when using the pool.

CHECK-IN, CHECK-OUT, AND STAY

Standard times:

Check-in: from 2:00 p.m.

Check-out: until 11:00 a.m.

Early Check-in:

If requested and available (property ready and staff available), the following charges apply:

Between 8:00 a.m. and 11:00 a.m. → 30% of the daily rate;

Between 5:00 a.m. and 8:00 a.m. → 50% of the daily rate;

Before 5:00 a.m. → one additional daily rate.

Late Check-out:

If requested and available, the following charges apply:

Until 5:00 p.m. → 30% of the daily rate;

Until 8:00 p.m. → 50% of the daily rate;

After 8:00 p.m. → one additional daily rate.

Overtime Penalty:

A fee of 20% of the total daily rate per extra hour will be charged for stays beyond check-out time, with additional fees if future reservations are affected.

CANCELLATIONS AND MODIFICATIONS

Cancellation policies prior to the scheduled check-in date will follow the specific conditions provided for each property at the time of booking.

You are responsible for reading this information before completing your reservation.

In case of cancellation or no-show on the scheduled check-in date (or afterward), no refund will be granted under any circumstances.

Likewise, no refund will be provided if you decide to vacate the property before the end of the stay.

Changes to reservation dates are only allowed upon prior written confirmation by Moments Stays,

and Moments Stays is not obliged to approve such requests.

PET POLICY

For properties that accept pets, small animals (up to 10 kg) with up-to-date vaccinations and friendly temperament are allowed,

upon prior request via WhatsApp at +55 81 98396-5474.

Maximum of 1 pet per every 2 rooms reserved.

An additional fee of R$ 60.00 per night per pet will be added to the total reservation value.

Special Cases:

Requests that do not meet the above requirements may be evaluated individually, based on pet size, length of stay, property dimensions, and specific rules.

If approved, a special security deposit of R$ 5,000.00 (five thousand reais) will be required, intended exclusively to cover potential damages or extra expenses related to the pet’s stay.

This deposit must be fully paid 3 days prior to check-in and will be refunded after check-out inspection, provided no damage or additional cleaning is found.

Requirements:

You must ensure your pet is vaccinated and free of parasites.

The use of property items for the pet’s comfort or hygiene is not allowed.

Restricted Areas:

Pets are not allowed in shared pools and must remain leashed in common areas of the condominium.

Responsibility:

Any infraction, damage, or incident caused by the pet is the responsibility of the guest, with a fine of R$ 500.00 per occurrence, plus repair or replacement costs.

HOUSE SETUP, FURNITURE, AND ITEMS

Furniture and Décor:

Do not alter the original arrangement of furniture, cabinets, or decorative items.

Any modification or damage will be charged accordingly.

Equipment:

Electronic or decorative items must not be moved to other rooms or outdoor areas.

Responsibility:

Any damage or incident is the guest’s responsibility, with a fine of R$ 500.00 per occurrence, plus any applicable repair or replacement costs.

Broken or Damaged Items:

During your stay, the property and all items within it are under your responsibility.

If any item is broken or damaged due to misuse or human action, you will be responsible for replacement or repair costs, including any shipping expenses.

LINEN, AMENITIES, AND CONSUMABLE ITEMS

Linen Change:

Linen replacement is available at an additional cost:

R$ 80.00 per double set (1 double bed for two people)

R$ 40.00 per single set (1 single bed for one person)

Examples:

1 double bed → R$ 80.00

1 double + 1 single bed → R$ 120.00

1 double + 2 single beds → R$ 160.00

Important:

Housekeepers are not authorized to deliver extra linens directly to guests.

For additional requests, please contact your host and request the cost table.

Complimentary Change:

Stays of 6 nights include one complimentary linen change, performed on the third day of stay, subject to scheduling.

Additional Usage:

If the guest requests or uses extra linen not included in the courtesy change, the value will be charged at check-out according to the current price list.

Usage Rules:

Do not use towels, sheets, or blankets for purposes other than their intended use.

Consumable Items:

Some properties provide basic consumables (sponge, dish soap, toilet paper, bottled water, etc.) at check-in.

If daily cleaning service is included, these items will be restocked; otherwise, they will be restocked every 4 days.

ENERGY CONSUMPTION

Electricity is charged separately, based on the consumption registered on the property’s meter.

The rate is R$ 1.10 per kWh consumed, with readings taken at check-in and check-out.

Payment must be made within 24 hours after check-out.

RULES AND LEGISLATION

Condominium Infractions:

Violations of condominium regulations may result in fines or cancellation of the stay, in addition to financial losses.

Noise and Coexistence:

Respect the Local Noise Control Law.

Disturbance of Public Order:

Penalties will apply in the event of formal complaints from neighbors or the condominium.

Drying Clothes:

Do not hang clothes or items visible from the façade, balconies, or windows.

Responsibility:

Each formal complaint will result in a fine equal to 20% of the total reservation amount.

EXTRA SERVICES, CONTRACTS, AND EVENTS

Extra Services:

The hiring of any third-party or additional service must be pre-approved by the host.

Bands, Musicians, or Other Entertainment:

If only for the guests staying at the property, prior approval is required.

If it involves external guests or multiple suppliers, it will be considered an event, requiring authorization, an additional budget, and project planning.

Cleaning and Maintenance:

Extra services must be requested in advance and are subject to availability.

Unauthorized Services:

Hiring unapproved services will result in a fine of R$ 500.00 per day.

Unauthorized events will incur a fine of R$ 5,000.00 per hour, plus costs for damages, repairs, or replacements.

EXCESSIVE WASTE, IMPROPER DISPOSAL, OR POOR MAINTENANCE

Waste Disposal:

Guests must dispose of waste properly using designated bins and following recycling guidelines when applicable.

Improper Disposal:

Throwing waste in gardens, outdoor areas, floors, or the pool is strictly prohibited and subject to a R$ 300.00 fine per violation, plus cleaning costs.

Cleanliness and Organization:

Guests are responsible for maintaining reasonable cleanliness and organization during their stay and upon check-out.

Excessive Disorder:

If the property is left in extreme disarray (e.g., excessive garbage, bad odor, items out of place), a cleaning fee equal to one full cleaning rate will be charged.

Excess Waste:

Failure to properly dispose of accumulated garbage as instructed may also result in fines.

SANITATION SYSTEM USE

The property uses a biodigester/septic tank system for wastewater treatment, promoting environmental preservation.

It is strictly prohibited to dispose of toilet paper, sanitary pads, diapers, wet wipes, or any other solid material into the toilet.

Violation of this rule may cause clogging, damage to the system, and environmental harm.

All related repair or maintenance costs will be fully charged to the guest responsible for the reservation.

All bathrooms are equipped with appropriate bins for proper waste disposal.

POOL RULES

Hours of Use:

Private pools may be used freely, respecting quiet hours.

Shared pools must be used according to condominium regulations.

Hygiene:

A shower must be taken before entering the pool to preserve water quality.

Prohibited Items:

For safety reasons, glass cups, bottles, and food are not allowed in or around the pool area.

Cleaning:

It is prohibited to discard trash or oily substances in the pool.

If extra cleaning is required, a R$ 500.00 fine will apply.

If the pool must be drained for cleaning, a R$ 3,000.00 fine will apply, plus maintenance costs.

Maintenance:

During your stay, a pool technician will conduct daily maintenance at a prearranged time.

Shared Pools:

Rules and fines may vary if the incident affects shared condominium pools.

SMOKING POLICY

The property is strictly smoke-free, including bedrooms, bathrooms, and all indoor areas.

This rule applies to cigarettes, cigars, cigarillos, hookahs, vapes, and similar devices.

Outdoor Areas:

Smoking is only permitted in designated outdoor areas and must not disturb other guests or neighbors.

Violation Fine:

If smoke odor, ash, or cigarette butts are detected indoors, a fine equal to twice the cleaning fee will be applied, plus any deodorization or repair costs.

The guest is responsible for ensuring compliance with this rule by all occupants.

SECURITY DEPOSIT

A security deposit is required at check-in and will be held until the end of the stay:

Daily rate up to R$ 500 → Deposit of R$ 500

Daily rate from R$ 501 to R$ 1,500 → Deposit of R$ 1,000

Daily rate above R$ 1,501 → Deposit of R$ 2,000

Or 10% of the daily rate, whichever is greater.

Purpose: To cover potential damages, consumption charges (e.g., electricity), or other costs.

Refund: Fully refundable within 48 hours after check-out, minus any deductions for damages or consumption.

Excess Costs: If damages exceed the deposit amount, the guest must pay the remaining balance.

GOOD PRACTICES INCENTIVE

Guests who fully comply with all property rules, maintaining it clean and undamaged, will receive a 15% “Unforgettable Guest” discount coupon for a future stay at any Moments Stays property.

Eligibility:

The discount is granted after the final inspection by the host or cleaning team.

The coupon will be sent via email within 48 hours after check-out.

Validity: 6 months from the issue date.

Conditions: Non-cumulative with other promotions and applicable only to the daily rate (excluding fees such as cleaning or electricity).

PAYMENT METHODS

Accepted payment methods:

a) Credit card (subject to payment platform fees);

b) Bank slip (boleto);

c) PIX transfer.

If, for reasons beyond Moments Stays’ control, the rented property becomes unavailable, the guest will be offered a similar property or a full refund of all payments made.
