Terms and conditions of use

By confirming your reservation, you agree to these rules and the Terms of Use available on our website and other platforms.

“Moments Stays” is the company responsible for the website https://momentsstays.com and its subdomains.

“You” refers to the person who has an account on the Moments Stays website and/or guest booking a property with Moments Stays.

Below, we present the main points governing your stay:

SUBJECT MATTER

This AGREEMENT concerns the seasonal rental of the property managed by MOMENTS STAYS for you.

The properties listed on the website are residential, without hotel characteristics, following the rules of the seasonal rental law.

You acknowledge the local rules, the neighborhood rules, and municipal, state, and federal laws, and agree to comply with them, especially regarding “disturbance of public order laws”.

You also acknowledge the rules of the condominium where the property is located and agree to comply with them.

You must return the property and its contents in the same condition as when they were delivered.

Any infraction or damage to the property or its items will be your responsibility, with repair costs charged in advance, according to the estimate, in addition to fines established herein.

IDENTIFICATION AND ACCESS

Information at the time of booking: The number of guests (people and pets) must be duly filled in at the time of booking for evaluation, planning and pricing of accommodation (prices may vary depending on the number of guests according to the rules of each property).

The reservation is your responsibility and cannot be made for third parties.

Required Documentation: In addition to you, all invited guests, including children, must present a valid identification document to enter the property or condominium. Without this documentation, check-in will not be allowed.

Visitors: The entry of visitors must be previously authorized by the host. The presence of unauthorized persons will result in a fine of R$ 300.00 per additional person for each hour of stay in the property.

You authorize the storage of the following information:

Full name

Date of birth

Identity card or passport number

CPF (Brazilian tax identification number)

Full address

Phone number and email address

Check-in and check-out times

Name and identification document of other guests.

WEB CHECK-IN

To ensure the correct planning of your stay, it is mandatory to complete the pre-check-in form (Web Check-in) within the following deadlines, counted from the confirmation of the reservation:

Reservations made more than 30 days in advance: the form must be completed within 48 hours of reservation confirmation.

Reservations made less than 30 days in advance: the form must be completed within 24 hours of reservation confirmation.

Reservations made less than 7 days in advance: the form must be completed within 1 hour of reservation confirmation.

Extra Services: no extra or additional services not previously described are offered, except in special cases expressly pre-approved by the administration before check-in.

SAFETY AND RESPONSIBILITY

Accident Prevention: Be sure to turn off all electronic equipment and close doors and windows when leaving the property.

Responsibility for Valuables: You are responsible for your personal belongings. Do not leave personal items in common areas or with the property open. We recommend that you store valuables in a safe place.

Property Damage: Any damage caused to the property, decorative items, or equipment will be charged directly to the responsible party.

Child and Elderly Safety: Children and the elderly must be supervised by an adult at all times while using the pool.

External Security Camera: External cameras, visible and marked, installed in the area for security purposes only. There are no cameras in internal areas of the property! By confirming the reservation, the guest declares to be aware and in agreement.

CHECK-IN, CHECK-OUT AND STAY

Hours:

Check-in: From 2 PM.

Check-out: Until 11 AM.

IMPORTANT: Check-in is done via self check-in, without a staff member present on site.

Regarding early check-in: If the request is for an earlier time, and we have availability (property prepared and staff to perform the check-in), the request will follow the following commercial rule:

- Check-in between 8:00 AM and 11:00 AM, 30% of the daily rate;

- Between 5:00 AM and 8:00 AM, 50% of the daily rate;

- Before 5:00 AM, payment of an additional daily rate.

Regarding late check-out: If a later time is requested, and there is availability, the following commercial rule must be followed:

- Until 5:00 PM, 30% of the daily rate;

- Until 8:00 PM, 50% of the daily rate;

- After 8:00 PM, payment of an additional daily rate.

Overstay Fee: 20% of the total daily rate for each additional hour, with extra charges if it impacts future bookings.

CANCELLATIONS AND CHANGES

Cancellation policies before the scheduled check-in date will follow the conditions provided for each property at the time of booking. You are responsible for reading this information before booking the property.

In case of cancellation or no-show on the scheduled check-in date (or after it), there will be no refund of the amounts paid under any circumstances. Similarly, there will be no refund of the rent if you decide to leave the property before the deadline.

Changes to reservation dates will only be permitted with prior written confirmation from Moments Stays, and Moments Stays is NOT obligated to accept such a request.

Changes involving the addition of guests to a number exceeding that indicated at the time of booking may incur an extra charge per person per day, depending on the rules of each property, which must be paid before check-in.

PET POLICY

For properties that accept pets, small animals (up to 10kg) with up-to-date vaccinations and a friendly temperament are allowed, upon prior request via WhatsApp +55 81 98396-5474.

Maximum of 1 animal (for every 2 reserved rooms), respecting the proportion of breed to the size of the rented property, with an additional fee of R$ 60.00/PER DAY and PER PET to be included in the total reservation value;

Special cases that do not meet the above rule may be evaluated, upon prior request via WhatsApp +55 81 98396-5474, according to the size of the pets, length of stay, size and specific policies of the property, and if AUTHORIZED, a special security deposit of R$ 5,000.00 (five thousand reais) will be charged, to be used exclusively to cover any damages or additional expenses related to the animals' stay.

The aforementioned security deposit must be fully deposited 3 days before check-in and returned after the check-out inspection, provided that no damage or need for additional cleaning is found.

Requirements: You must ensure that the animal is vaccinated and free of parasites. The use of items in the property for the comfort or cleaning of the animal is not permitted.

Restricted Areas: Animals are not allowed in the communal pool and must remain on a leash and collar in social areas of the condominium.

Responsibility: Any infractions, damages or incidents caused by the pet are your responsibility, with a fine of R$ 500.00 per identified event, plus any costs for repairs or replacements.

HOUSE CONFIGURATION, FURNITURE AND OTHER ITEMS

Furniture and Decoration: Do not alter the original configuration of the furniture, cabinets or decorative items. Damage or alterations will be charged.

Equipment: Electronic and decorative items should not be moved to other rooms or outdoor areas.

Responsibility: Any damage or incidents are your responsibility, with a fine of R$ 500.00 per identified event, plus any costs for repairs or replacements.

Broken or damaged items: During your stay, the property and all items contained therein are your responsibility. If any damage or breakage is caused by human action, you will be responsible for the costs of replacement or repair, including any shipping expenses for item replacement.

LINENS, AMENITIES AND CONSUMABLE ITEMS

LINENS INCLUDED:

01 bath towel per adult or child guest, 01 pool towel per room or suite and bed linen for the suites booked.

Linen Usage Rules:

Do not use linen items (towels, sheets, blankets) for purposes other than those intended. COMPLIMENTARY LINEN CHANGE:

Reservations of 7 nights will be entitled to a complimentary linen change, carried out on the third or fourth day of stay, subject to prior scheduling with the service team.

ADDITIONAL USE OF LINENS:

If the guest requests or uses additional linens not included in the complimentary change or not previously provided as a bonus by the service team, the corresponding amount will be charged at the end of the stay, according to the current price list.

EXTRA LINEN CHANGE:

Linen Changes: Will occur at an extra cost of R$ 80.00 (eighty reais) for the double bed kit (items for 1 double bed, for two people) and R$ 40.00 (forty reais) for the single bed kit (items for 1 person).

Example: The room has 1 double bed (bed linens, 1 floor towel, 1 face towel, two bath towels) = R$ 80.00

Example: The room has 1 double bed and 1 single bed = R$ 120.00

Example: The room has 1 double bed and two single beds = R$ 160.00

Important: No housekeeper is authorized to release linen items to guests. For extra requests, please ask the service team for the cost list.

Included in your stay at check-in: 1 bottle of water, 1 detergent, 2 rolls of toilet paper per bathroom, 1 sponge, trash bag, 1 bath kit per suite (1 bottle of 35ml shampoo + 1 bottle of 35ml conditioner + 1 bar of soap 20g).

Important: For extra requests, please ask the customer service team for the cost list.

ENERGY CONSUMPTION

Additional Charge: Electricity is charged separately, based on consumption recorded on the electricity meter. The cost is R$ 1.10 per kWh consumed, with charges recorded at check-in and check-out, and must be paid within 24 hours of leaving the property.

RULES AND LEGISLATION

Violations of the Condominium Regulations: May result in fines or cancellation of your stay, in addition to additional financial losses.

Silence and Coexistence: Respect the Noise Law.

Disturbance of the Peace: Penalties will be applied in cases of formal complaints from neighbors or the condominium.

Drying Clothes: Do not hang clothes or items in any area of ​​the facade, or visible from balconies or windows, respecting the aesthetics of the property and condominium.

Responsibility: Each formal complaint will result in a fine of 20% of the total reservation value.

CONTRACTS, EXTRA SERVICES AND EVENTS

Contracts: The contracting of any outsourced extra service must be previously authorized by the host.

Band, Musicians and other attractions: These contracts, if only for the guests of the property, will be subject to analysis and prior authorization by the host. If they involve additional guests or multiple suppliers, they will fall into the category of events and will be subject to a project, additional budget, and prior authorization by the host.

Cleaning and Maintenance: Extra services must be requested in advance and are subject to availability.

Responsibility: Hiring additional services without prior authorization will be subject to a fine of R$ 500.00 per day that the unauthorized service is identified. In the case of unauthorized events, a fine of R$ 5,000.00 per hour of the event will be applied, in addition to the costs necessary for repairs or replacements resulting from damage, incidents caused, and other infractions.

EXCESSIVE WASTE, IMPROPER DISPOSAL, OR POOR MAINTENANCE

Responsibility for Disposal: Guests must dispose of waste properly, using the provided trash cans and respecting the selective disposal guidelines, when applicable.

Prohibition of Improper Disposal: Disposing of waste in inappropriate locations, such as gardens, outdoor areas, floors, or pools, is strictly prohibited and will result in a fine of R$ 300.00 per infraction, in addition to the costs necessary for cleaning or repair.

Maintaining Organization: Guests are responsible for maintaining the property in a reasonably clean and organized condition during their stay and at check-out.

Excessive Disorder: If the property is left in a state of extreme disorder, with a significant accumulation of garbage, items out of place, or bad smells, an additional fine corresponding to the value of a new cleaning fee will be applied, depending on the extent of the damage and the effort required to restore the property to its original condition.

Excess or Accumulation of Garbage: Excessive accumulation of garbage in the property, when not disposed of appropriately according to the instructions provided at check-in, may result in the application of fines.

USE OF THE SANITARY SEWER SYSTEM

The property uses a biodigester/septic tank for the treatment of sanitary waste, a technology focused on environmental preservation and local sustainability.

It is expressly forbidden to dispose of toilet paper, sanitary napkins, diapers, wet wipes, or any other solid materials in the toilet.

Failure to comply with this rule may cause blockages, damage to the sewer system, negative environmental impacts, and interruptions in the regular use of the property.

Any maintenance, repair, or unclogging costs resulting from improper use will be fully passed on to the guest responsible for the reservation, upon proof by the administration.

There are trash cans in all bathrooms of the property, sufficient and adequate for the disposal of the aforementioned items, contributing to the proper functioning of the system and the reduction of environmental impacts in the region.

POOL USAGE RULES

Operating Hours: The private pool may be used in its entirety respecting quiet hours; the communal pool must be used in accordance with condominium rules.

Hygiene: It is mandatory to take a shower before entering the pool to preserve water quality.

Prohibited Items: For your safety, the use of glasses, glass bottles, or other objects that may cause accidents in the pool area is prohibited. Eating inside the pool is also prohibited.

Cleanliness: It is prohibited to discard trash, debris, or objects inside the pool, as well as to use oily products in the water.

Responsibility: If additional cleaning is necessary due to misuse by guests, a fine of R$ 500.00 will be applied for extra maintenance. If it is necessary to empty and dry the pool for repairs or complete cleaning, a fine of R$ 3,000.00 will be applied, in addition to the costs of the necessary maintenance.

Maintenance: Every day during your stay, the pool attendant will check the pool in the early morning and/or early evening. In cases of situations that compromise the safety or quality of the pool, its use may be restricted or temporarily suspended.

IMPORTANT: If you plan to use the private pool at night, you must inform the staff so that the pool attendant can visit at an alternative time.

Communal Pools: These rules and fines may be altered if the impact has been generated in the communal pools. In this case, the condominium will be responsible for determining the penalties.

GARDEN MAINTENANCE

Every day during your stay, the gardener will check the garden in the early morning and/or late afternoon.

NO SMOKING

Smoke-Free Property: Smoking is strictly prohibited inside the property, including bedrooms, bathrooms, and indoor common areas. This rule applies to cigarettes, cigars, cigarillos, hookahs, vaporizers, and any similar devices.

Permitted Outdoor Areas: Smoking is only permitted in designated outdoor areas, when available, provided it does not cause inconvenience to other guests or neighbors.

Penalty for Non-Compliance: If cigarette odor, residue (butts), or signs of smoke are identified inside the property, a fine equivalent to twice the property cleaning fee will be applied, in addition to additional costs for odor elimination or necessary repairs.

Responsibility: The guest is responsible for ensuring compliance with this rule by all occupants of the property.

SECURITY DEPOSIT (SECURITY DEPOSIT)

Payment of a security deposit is mandatory at check-in and will be retained until the end of the stay. The deposit amount will be:

Daily rates up to R$ 500 → Deposit of R$ 500

Daily rates between R$ 501 and R$ 1,500 → Deposit of R$ 1,000

Daily rates above R$ 1,501 → Deposit of R$ 2,000

OR 10% of the daily rate, whichever is greater.

Purpose: The security deposit is intended to cover:

Any damage to the property, decorative items, furniture, or equipment.

Payment of consumable items, such as electricity, which will be calculated based on consumption recorded during the stay.

Refund: The amount will be fully refunded within 48 hours after check-out, deducting any consumption costs or repair of damages, if applicable.

Deductions: If damages, infractions, or unpaid additional consumption are found, the corresponding amount will be deducted from the deposit. If costs exceed the security deposit, the guest will be responsible for paying the difference.

INCENTIVE FOR GOOD PRACTICES

Recognition for Compliance with Rules: If the guest fully complies with all property rules, keeping the space clean, organized and undamaged, they will be eligible for a coupon for:

15% discount on a future stay at any of our properties.

Eligibility Criteria: The discount will be offered upon final verification of the property by the host or cleaning staff. The coupon will be sent by email within 48 hours after check-out.

Coupon Validity: The coupon will be valid for 6 months from the date of issue and will be applicable to future bookings made directly through the Moments Stays website or our reservations center.

Conditions: The discount is not cumulative with other promotions and will only be applied to the daily rate, excluding additional fees (cleaning, energy consumption, etc.).

PAYMENT METHODS

The payment methods available for making a reservation are:

a) Credit card (subject to fees applied by the payment method);

b) PIX (Brazilian instant payment system);

If, for any reason beyond our control, the rented property becomes unavailable, we offer our clients the choice of a similar property or a full refund of all amounts paid.
